These Terms of Service ("Terms") govern your access to and use of the website located at www.eaglescapeslawncare.com ("Site") and any landscaping, lawn care, snow removal, or related services ("Services") provided by Eagle Scapes & Home Services ("Eagle Scapes," "we," "us," or "our"). By using our Site or engaging our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By browsing the Site, submitting a contact or quote request form, chatting with us through our website widget, or hiring Eagle Scapes for any Services, you confirm that you are at least 18 years old and that you accept these Terms in full. If you do not agree, please do not use the Site or our Services.

2. Description of Services

Eagle Scapes & Home Services provides residential and commercial property maintenance, landscaping, seasonal cleanups, pruning, snow and ice removal, and related home services in Aurora, Chagrin Falls, Bainbridge, South Russell, Auburn, and surrounding communities in Northeast Ohio. Service availability, pricing, and scope are confirmed in a written or verbal estimate before work begins.

3. Estimates & Scheduling

• Estimates are valid for 30 days from the date issued unless otherwise stated.
• All scope changes must be communicated in advance and may affect price and timing.
• Service scheduling is subject to weather, equipment availability, and existing route commitments.
• We will make reasonable efforts to notify you of significant schedule changes by phone, email, or SMS.

4. Payment Terms

• Payment is due upon completion of each service or per the schedule outlined in your estimate or contract.
• We accept cash, check, and major credit/debit cards. Card payments may include a small processing fee.
• Past-due invoices over 30 days may accrue interest at a rate of 1.5% per month, or the maximum allowed under Ohio law, whichever is lower.
• Returned checks may be subject to a fee of up to $35.

5. Cancellations & Refunds

You may cancel or reschedule a service by contacting us at least 24 hours before the scheduled visit. Services already rendered are not refundable. Large project deposits are refundable, less reasonable costs incurred, if cancellation is requested in writing more than 7 days before the scheduled start date.

6. Property Access & Conditions

• You agree to provide safe, reasonable access to the work area, including unlocking gates and securing pets.
• You are responsible for identifying and marking sprinkler heads, low-voltage lighting, invisible fence wires, septic components, and any other concealed installations before work begins.
• Eagle Scapes is not liable for damage to unmarked items or items not reasonably visible.

8. Warranty & Plant Replacement

We stand behind our workmanship. New plant installations carry a limited one-season replacement warranty, provided proper watering and care instructions were followed by the customer. The warranty does not cover damage from drought, frost, vandalism, animals, neglect, or acts of nature. Hardscape installations carry a one-year workmanship warranty. Warranties are non-transferable.

9. Limitation of Liability

To the maximum extent permitted by law, Eagle Scapes & Home Services, its owners, employees, and subcontractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from or related to our Services shall not exceed the amount you paid us for the specific service giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Eagle Scapes & Home Services, its owners, employees, and subcontractors from any claim, demand, damage, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

11. Intellectual Property

All content on this Site — including text, photos, logos, graphics, and design — is owned by Eagle Scapes & Home Services or its licensors and is protected by U.S. copyright and trademark law. You may not copy, reproduce, modify, or distribute any content without our prior written permission.

12. Third-Party Services

Our Site may use third-party tools (for example, chat widgets, analytics, and form submission services). Your interactions with those services are governed by their own terms and privacy policies. We are not responsible for third-party content or practices.

13. Governing Law & Venue

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Portage County or Cuyahoga County, Ohio, and you consent to the jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Site or our Services after changes are posted constitutes acceptance of the updated Terms.
